Terms and Conditions Welcome to eSale-etc. This website and any affiliated and/or linked websites provide services to visitors according to the following Terms and Conditions. By accessing, viewing or using this website and its affiliated and/or linked websites, visitors acknowledge and accept these Terms and Conditions, and understand and intend them to be the legal equivalent of a signed, written contract. eSale-etc may modify these Terms and Conditions at any time and for any reason. Continued use of the website, and its affiliated and/or linked websites will be deemed to constitute your acceptance of any such modifications. Warranty/Guarantee eSale-etc offers a fourteen (14) day satisfaction guarantee. Except for special order or 'final sale' merchandise, customers may return any item within 14 days of receipt for a refund of the purchase price. Limited fourteen (14) day warranty: eSale-etc warrants all merchandise against defects in manufacturing and workmanship. This warranty does not apply to items subjected to wear, abuse or physical damage, however caused. eSale-etc is not responsible for insurance or protection of the merchandise while in the customer's possession, and will not be liable for any loss, theft or resulting damages. Details are provided in our Shipping and Returns Policies. Privacy Personal customer information is confidential and will not be disclosed, rented or sold to non-related third parties. Please refer to eSale-etc's Privacy Policy for details. Security Credit card purchases at eSale-etc are handled using a Secure Socket Layer (SSL) when connecting to our server. This protocol encrypts personal information, protecting it from interception and misuse. Cookies eSale-etc may use cookies to enhance the customer's shopping experience. Cookies are only used to retain important aspects of a visit to our site. They are never used to collect personal information about our customers for outside use. Sales Tax eSale-etc is located in Connecticut, USA. We are required to collect sales tax for Connecticut residents or for items delivered in Connecticut. It is not our responsibility to collect or declare sales tax for items sent to other states. If state laws require that an eSale-etc customer pay sales tax on purchases from eSale-etc, it is the customer's responsibility to do so. Exports Merchandise sent to other countries may be subject to import duties or excise taxes. Any such fees will be collected from the customer by the customs department of that country according to their regulations, and prior to release of the merchandise. Credit Card Payments eSale-etc generally accepts payment by Mastercard or VISA from its U.S. customers only, however we reserve the right to refuse payment by credit card at our sole discretion. In all cases, customers will be contacted by telephone to confirm the details of the transaction before shipment. In the event that payment by credit card is refused by eSale-etc, the customer will be offered reasonable alternative methods of payment. eSale-etc utilizes state-of-the-art technology to reduce credit card fraud. Credit card customers are required to successfully complete either Transact-Secure 'Tier 1' or Tier 2' identification before the transaction is processed. None of the personal information requested by Transact-Secure is available to eSale-etc; it is collected on secure servers only for the purpose of verifying the customer's identity and matching the customer with the credit card being used. More information about Transact-Secure is available at their website: www.transact-secure.net Customer's who do not wish to complete Transact-Secure's verification process may purchase from eSale-etc by using an alternative payment method. Shipping/Insurance - US, Canada eSale-etc ships all items via FedEx. U.S. transactions under $1,000 are sent using FedEx 2-Day (Second Day) package delivery. U.S. and Canadian transactions over $1,000 and above via FedEx Next Day Priority Service: delivery before 10:30 AM on the next business day in the US; two-day service to Canada. Packages are fully insured by eSale-etc while in the possession of FedEx. Insurance coverage is provided by eSale-etc's carrier, and not by FedEx. Each package is individually insured for the full value of its contents. In the event that a package is lost or mishandled by FedEx, the cost of insurance is not recoverable. The customer's signature will be required before packages are released by FedEx. We will call each customer before scheduling shipment to assure that he/she will be available to sign for the package when it arrives. Under some circumstances and at eSale-etc's sole discretion, packages may be shipped to a staffed FedEx counter and held for pick-up by the addressee. eSale-etc will not ship to any address that has a 'signature release' on file with FedEx. Once the package has been delivered to the customer's location by FedEx, the customer agrees to accept sole responsibility for the merchandise. The customer is responsible for any loss or damage, however caused, from the point of delivery up to and including the return to and receipt by eSale-etc of the merchandise in its original condition. Orders are processed and shipped on a first-come, first-served basis. Normally, loose gems are shipped on the next business day after receipt of payment. Mounted gems are normally shipped within three business days after receipt of payment. Delivery must be within the United States or Canada, and may not be sent to P.O. Boxes. With credit card payment, eSale-etc reserves the right to restrict delivery to the credit card billing address of the cardholder. Shipping and insurance fees are non-refundable unless a return is the result of an error by eSale-etc, e.g., wrong item shipped. Shipping/Insurance - International eSale-etc may at its sole discretion decide whether to ship merchandise to locations other than the United States or Canada. Customers interested in having merchandise delivered to International locations must contact info@esale-etc.com before ordering. Returns - US Customers eSale-etc accepts merchandise returns according to the conditions outlined in this section. Returned items must be in their original condition: unworn or undamaged. Special-order items are not returnable, unless the return results from an error by eSale-etc. All returns must have a Return Merchandise Authorization (RMA) number obtained from eSale-etc within 14 days after customer receipt of the item. The customer is responsible for contacting eSale-etc to obtain an RMA before returning the merchandise. The RMA number must be clearly written on the outside of the package near the address label or the package will not be accepted. Customers must package the merchandise securely. Inside the package, the customer must include the merchandise, its original container, i.e., jewelry box, any original gem laboratory certificates, and any original Gemprint registration certificates. In addition, the customer must include his/her name, address, item number, item purchase price, RMA number, and form of payment, i.e., credit card, money order, bank wire, etc. If original gem laboratory or Gemprint certificates are not included with the returned merchandise, eSale-etc will reduce the amount refunded as follows:
All returns must be shipped to eSale-etc through the U.S. Post Office (USPS), registered and fully insured at the customer's expense. Returns should be sent to:
Upon receipt, all merchandise will be inspected. It must be in its original condition; free from damage, alterations or wear. Diamonds will be Gemprinted again to assure that the returned item matches the diamond sent originally. Gemprint provides a scientific way to positively identify any diamond, both at the time of purchase and later. It is becoming the global standard for diamond identification, and has been used as conclusive evidence in court cases involving the recovery of stolen diamonds. If eSale-etc determines that the merchandise is in its original condition, free from damage, alterations or wear, refunds will be issued within five business days after inspection by eSale-etc. Credit card purchases will be electronically credited to the customer's account. Other payments or refunds will be issued by corporate check. Returns - Canada, Other International Locations Except for return shipment procedures, eSale-etc can accept returns from Canada and other International locations following the process described in the Returns - US Customers section above. Returns from Canada and other countries must be shipped by FedEx according to instructions provided by eSale-etc customer service personnel at the time an RMA number is requested. The customer will be responsible for FedEx shipping charges, plus any import duties and/or excise taxes incurred upon return shipment to the United States. These amounts will be deducted from the customer's refund, as appropriate. Return shipments from outside the United States that are not coordinated through eSale-etc will not be accepted. Gem Laboratory Certificates & Grading Reports eSale-etc is committed to providing the best quality diamonds to its customers. All diamonds weighing over 0.50 carat will be accompanied by a certificate from one of the following laboratories:
These independent laboratories are highly respected; among the most reputable in the world. eSale-etc guarantees that each diamond sold will match the gem described on its certificate. Since diamond grading is subjective, the company does not guarantee the accuracy of any diamond-grading laboratory. eSale-etc is not responsible for any dissimilarities and/or differences that might result from repeated evaluations by independent gem laboratories eSale-etc provides these certificates and grading reports to the customer solely for his/her own use, and is not responsible for any claims that may arise as a result of these evaluations. Other Legal Information While eSale-etc makes reasonable efforts to provide accurate, up-to-date materials, the information, materials, products, and services available on this site may contain inaccuracies, typographical errors or outdated information. eSale-etc is not responsible for and need not honor typographical or pricing errors on the site. eSale-etc reserves the right to refuse or cancel orders at any time, including but not limited to orders that contain incorrect prices or product descriptions, orders in which eSale-etc believes the customer has violated applicable law, and orders that eSale-etc believes are harmful to eSale-etc. Customers acknowledge that use of information provided on this website, affiliated and/or linked websites is solely at their own risk. eSale-etc logo, copy, images and all other items on its website are protected by US and International copyright laws, all rights reserved.
